Criminal charges against Alec Baldwin over Rust set shooting supported by Halyna Hutchins’ family

The family of Halyna Hutchins, the cinematographer killed when a prop gun held by Alec Baldwin discharged on a film set in 2021, has supported the decision for charges to be filed.

On Thursday, the Santa Fe County District Attorney Mary Carmack-Altwies and special prosecutor Andrea Reeb announced charges of involuntary manslaughter will be brought forth upon Baldwin and crew member Hannah Gutierrez-Reed, who was armourer on the set of Rust.

Hutchins’ family responded to the news in a statement released by lawyer Brian J. Panish saying, “It is a comfort to the family that, in New Mexico, no one is above the law.”

“We want to thank the Santa Fe Sheriff and the District Attorney for concluding their thorough investigation and determining that charges for involuntary manslaughter are warranted for the killing of Halyna Hutchins with conscious disregard for human life,” the statement read.

“Our independent investigation also supports charges are warranted. It is a comfort to the family that, in New Mexico, no one is above the law.

“We support the charges, will fully cooperate with this prosecution and fervently hope the justice system works to protect the public and hold accountable those who break the law.”

Andrea Reeb, a special prosecutor on the case, cited a “pattern of criminal disregard for safety” on the set of Rust.

“If any one of these three people – Alec Baldwin, Hannah Gutierrez Reed or David Halls – had done their job, Halyna Hutchins would be alive today. It’s that simple,” she said.

This development comes after a long investigation into the shooting and multiple smaller settlements, including an undisclosed amount paid by Baldwin to Hutchins’ family and a wrongful death lawsuit settled by the actor and other Rust producers in October 2022.

The wrongful death lawsuit was filed by Hutchins’ widower Matthew. Along with the settlement, he was assigned as an executive producer of Rust with production on the Western film set to resume this month.

Matthew, who shares son Andros with Hutchins, said in a statement at the time, “I have no interest in engaging in recriminations or attribution of blame (to the producers or Mr. Baldwin). All of us believe Halyna’s death was a terrible accident. I am grateful that the producers and the entertainment community have come together to pay tribute to Halyna’s final work.”

The response from Baldwin’s attorney strongly refuted the charges.

“This decision distorts Halyna Hutchins’ tragic death and represents a terrible miscarriage of justice. Mr. Baldwin had no reason to believe there was a live bullet in the gun – or anywhere on the movie set,” attorney Luke Nikas said.

“He relied on the professionals with whom he worked, who assured him the gun did not have live rounds. We will fight these charges, and we will win.”

Baldwin has maintained his denial over pulling the trigger on the set of Rust, despite a FBI investigation saying otherwise.

He and wife Hilaria Baldwin have spoken openly about the tragedy and the struggles their family has faced after the ordeal. Early on, the actor even spoke out about the support he’d been receiving by fans.

An attorney for Gutierrez Reed said the charges were “the result of a very flawed investigation and an inaccurate understanding of the full facts”.

“We intend to bring the full truth to light and believe Hannah will be exonerated of wrongdoing by a jury,” Jason Bowles said in a statement on Thursday.

“She has been emotional about the tragedy but has committed no crime.”
